In consideration of Austin Area Foundation and United Way of Mower County accepting my entry, I, the participant, intending to be legally bound, hereby waive and forever release any and all rights and claims for damages or injuries that I may have against Austin Area Foundation and United Way of Mower County, the Event Director(s), and all event sponsors, volunteers, employees, agents, representatives, contractors, and any other individuals or organizations assisting with the event. This release applies to any and all injuries, damages, losses, or claims arising before, during, or after the event, including damage to personal property. I acknowledge that this release is binding upon my heirs, executors, administrators, legal representatives, and assigns.
I understand that participating in a road race is a potentially hazardous activity. I certify that I am medically able to participate, am properly trained, and assume all risks associated with participation, including but not limited to falls, contact with other participants, spectators, or vehicles, weather conditions, traffic, road or trail conditions, and any other risks commonly associated with road racing. I knowingly and voluntarily assume these risks and waive any claims arising from them. I will obey all road and traffic laws. I agree to abide by all decisions made by race officials regarding my safe participation in the event. I further certify that I am physically fit and sufficiently trained to complete this event.
In the event of illness, injury, accident, or medical emergency occurring during the event, I authorize the Event Director(s) and event personnel to obtain emergency medical treatment deemed necessary on my behalf from any licensed physician, hospital, clinic, emergency medical service, or other qualified medical provider. I understand and agree that I am solely responsible for all costs associated with any medical treatment, transportation, hospitalization, medications, or related services provided to me.
As applicable to my participation, I agree to comply with any public health recommendations, state or local regulations, or event safety requirements that may be in effect at the time of the event, including communicable disease prevention measures if applicable.
I grant permission to Austin Area Foundation and United Way of Mower County, its representatives, sponsors, and event partners to use my name, voice, likeness, photographs, video recordings, race results, or other electronic or printed recordings of my participation for legitimate promotional, educational, historical, or marketing purposes without compensation or further permission.
This event follows the standard running industry policy that all entry fees are non-refundable. Austin Area Foundation and United Way of Mower County reserves the right to postpone, modify, or cancel the event due to circumstances beyond its control, including but not limited to severe weather, natural disasters, public safety emergencies, governmental orders, or other unforeseen circumstances. No refunds will be issued under these circumstances. Austin Area Foundation and United Way of Mower County also reserves the right to modify the event course, schedule, or other event details without prior notice. I understand that my registration is non-refundable and that race bibs are non-transferable.
By submitting my registration, I acknowledge that I have carefully read, fully understand, and voluntarily agree to the terms of this Waiver and Release of Liability, including the assumption of risk and the non-refundable registration policy. If the participant is under 18 years of age, this agreement must be accepted by a parent or legal guardian on the participant’s behalf.
